General

These clauses apply to everything BREA sells.

1. Who we are

BREA — Brain Rehabilitation E-learning Academy — provides education for professionals who treat people with brain injury. BREA organises workshops and courses, delivers in-company training, and sells books, tests and assessment material.

BREA is registered in Portugal under the name Brain Rehabilitation EA, Unipessoal LDA as a sociedade por quotas, NIPC 519590074, address Rua de Cima de Santana 11B, 9940-213 Santo António, São Roque do Pico, Azores, Portugal, telephone +351 917 042 516, email info@brea.biz.

2. What do these terms and conditions contain

These terms and conditions apply to every order placed through this website and to every training BREA agrees to deliver. By placing an order you accept them. We may only change them for future orders: the version in force when you ordered is the one that governs your order, and you can ask us for a copy of it at any time.

If you order on behalf of someone else — an employee, a colleague, a team — you are the buyer, and you are obliged towards BREA to make these terms and conditions known to the people you are ordering for and to impose these terms and conditions upon them.

We expressly reject the general terms and conditions of any business that orders with us.

3. What do the words mean

Training
Every training is either a workshop or a course given in a classroom or online. It starts at a certain date and can contain more than one moment in time. The location can be a physical address or online.
In-company training
A training tailored to the need of an organisation.
Dates
Dates are the days on which the training is scheduled.
Starting date
Is the first day of the training.
Product
A product can be a book, a test or an assessment, physical or as a download.
Price
All prices are described without VAT. For consumers and businesses in the EU VAT will be calculated according to the EU-laws. The local VAT percentages will be added to the price for consumers and businesses. EU law only allows 0% VAT when a business is registered in VIES.
Order
An order is the purchase of one or more items and paid at one moment in time. An order is pending until it is paid for, and confirmed once payment has reached us.
Registration
A participant can apply for registration for a training by the purchase of a training. The registration is complete once the payment is made and the registration is confirmed.
Buyer
A consumer or a business that places the order and pays for it.
Business
A business is an organisation or economic system where people work together to create, buy, and sell goods or services in exchange for money. There are different tax rules for businesses.
Consumer
A person buying outside their trade, business or profession. Some clauses below apply to consumers only.
Participant
The person attending a training. The participant does not need to be the buyer.

4. How an order is made

You add what you want to the shopping basket, and go to checkout. Checkout takes three steps:

  • Filling in your invoice details and your address for delivery of products.
  • Filling in the information of participants for registration.
  • The payment.

Before you pay you see everything in the order, the price of each item and the total.

Pressing the order button places the order and creates a payment obligation. Your order is accepted once we have received your payment and confirmed it to you by email. That confirmation is the moment the contract is concluded.

As soon as your details have been processed by BREA, you will receive a payment receipt and further information about the training or the product delivery.

A purchase will be reserved for you once you have ordered, and the reservation is for as long as mentioned in clause 6. If we cannot accept an order — a training has no place available, a product is out of stock, the wrong information was displayed on the website — we tell you and refund anything already paid.

5. Prices, VAT and currency

All prices are described in euro and without VAT. For consumers and businesses in the EU VAT will be calculated according to the EU-laws. The local VAT percentages will be added to the price for consumers and businesses. EU law only allows 0% VAT when a business is registered in VIES.

The price you are asked to pay at checkout is the final price and the VAT is shown separately.

Changes in VAT rates, statutory regulations, or provisions may require BREA to adjust the prices. The difference in price will be charged to the buyer.

The price of a training covers the training itself. For each training, it is indicated if and which materials the participant must purchase separately.

6. Paying and order reservation

There are two ways to pay, and the checkout shows which are available for your order.

  • Online, by card or another method our payment provider offers. You are taken to Stripe to pay; we never see or store your card details. Your order is confirmed as soon as the payment succeeds.
  • By bank transfer. We email you the details and hold what you ordered while we wait. Your order is confirmed once we have received the money in our account and confirmed it to you by email.

A bank transfer must reach us within the period stated in the email with the payment details, counted from the day the order is placed. If it does not, the order is cancelled automatically. We tell you by email when that happens, and you are free to order again.

When you pay online, the payment page stays open for a limited time. If it closes before you have paid, nothing is charged. If you would still like to purchase, just restart the procedure from your shopping basket.

7. Invoices

You will receive an order confirmation by email as soon as we have confirmed your payment. The invoice will be sent to your email within five working days of the payment. The invoice is your proof of payment.

8. Consumers and businesses

BREA sells both to businesses and to consumers. If you are a consumer you have the right to cancel (clause 9) and guarantees (clause 10).

If you buy as a business — an employer registering staff as participants, a business ordering material or a business ordering an in-company training — the clauses that say “consumer” do not apply to you. Cancellation terms differ as described in clauses 20, 21, 29 and 35.

9. General right of cancellation (consumers)

If you are a consumer, by law you may cancel your order within fourteen days without giving a reason. Cancellation can only be done in writing.

In general we will refund everything we have received from you, including the standard delivery cost, using the same means of payment you used. For training the refund will be within fourteen days of being told, for products we will wait until the products are returned and checked for damage, before refunding the payment.

There are three exceptions:

  • If you order a training within the fourteen days of the starting date, you may still cancel, but you will not receive a refund. You may however have someone else replace you free of charge. In this case, the original participant remains liable for the course fee. The replacement must, however, comply with the explicit registration conditions of the relevant course.
  • If you buy a download and ask for it to be made available immediately, you are asked to confirm that you understand you lose the right of withdrawal once the download starts. Without that confirmation the downloaded product will not work.
  • Material that is sealed, or a test or assessment supplied under licence to a named user, cannot be returned once unsealed or once the licence has been issued.

10. Guarantees and conformity

Every product we deliver must be as described, fit for its purpose, and free of defects. If the product does not meet these requirements, BREA will repair or replace the product, or settle for a price reduction or a refund where repairing and replacing is not possible or not reasonable.

Please tell us as soon as you notice the problem, so that we can put it right quickly.

11. Complaints and disputes

BREA works to the best of its knowledge and ability, to the standards of good professional practice. What we undertake is a best-efforts obligation. If you are not satisfied, we want to hear it, because a complaint is how we find out what to improve.

Should you have a complaint, you may report it in writing to BREA, using the contact form within a period of two weeks after the training or receiving the product. Clearly state your name, your address, and what happened. We confirm receipt in writing, treat every complaint confidentially, and aim to answer within four weeks. If it takes longer, we will tell you when to expect an answer. Complaints and their outcomes are recorded and kept for one year.

If we cannot resolve it between us and you are a consumer, you can take the dispute to your local alternative dispute resolution or you may use the electronic complaints book.

Consumers in the European Union can seek assistance from the European Consumer Centres Network (ECC-Net). This network provides free information and assistance to consumers who have a dispute with a trader established in another EU Member State, Iceland or Norway. As a general rule, the consumer contacts the European Consumer Centre in their country of residence, which may then cooperate with CIMARA, the center in the region where the trader is established. Consumers living in the UK can go to the UK International Consumer Center.

12. Intellectual property

The intellectual property rights of the (teaching) materials, models, techniques, and instruments used by BREA in the execution of the training belong exclusively to BREA, unless they belong to someone else who has allowed BREA to use them.

You may use what we give you for your own professional practice. Without our prior written agreement you may not reproduce, copy, publish, lend, resell or otherwise make available — whether or not for payment, whole, in part, or as extracts — any material used during a training or supplied with a product, for your own use or anyone else’s.

Recording a training, in sound or picture, needs our permission in advance. This protects the other participants as much as it protects us: participants discuss their own case studies during the training.

13. Personal data

BREA, and anyone working for BREA, treats what you tell us as confidential. In doing so, BREA complies with the applicable privacy legislation, as described in BREA’s privacy statement.

When you give us someone else’s details — a participant you are registering — you confirm that you have the authority to do so and that you have informed the person concerned that the data is being processed by BREA.

14. What our teaching is, and what it is not

BREA educates professionals in clinical reasoning by providing knowledge. BREA does not treat patients, and is therefore not responsible for damage to individuals caused by bad clinical judgement or bad clinical reasoning of a professional during the process of treatment. The clinical judgement about a patient is always the responsibility of the professional.

BREA is liable for damage caused by intent or gross negligence on its part, and for anything the law does not permit it to exclude. Beyond that, our liability for any order is limited to the amount you paid for it, and we are not liable for indirect or consequential loss.

15. This website

BREA takes care to keep the information on this website correct, but cannot guarantee that it is accurate and complete at every moment. We may change it without prior notice or announcement.

Where we link to another site, it is for your information. We are not responsible for the content or the availability of sites we do not run, and we are not liable for damage arising from inaccuracy or incompleteness on them. If something here is wrong, tell us and we will correct it.

An obvious error in a price or a description does not bind us: if a price is plainly wrong, we tell you before taking the order further and you decide whether to continue at the right price.

16. Circumstances beyond control

Neither of us is in breach for failing to do something that has become impossible through circumstances outside our control — illness, a venue lost at short notice, a strike, a failure of transport or of infrastructure, an act of authority. If that happens we tell you as soon as we can and agree what to do next: set a new date, or end the contract and refund what you have paid for what has not been delivered.

17. Applicable law and jurisdiction

Portuguese law applies to these terms and to everything BREA delivers.

Training: Workshops and courses

18. Registration

You can register for a training by selecting a training at a certain starting date and adding this to your shopping basket. Make sure that you or the participants that you are registering comply with the entry requirements — a profession, a qualification, an earlier module — which are stated on the page for the training. Then go to the checkout, provide us with your invoice details, the information of the participants and choose how to pay. Once BREA has received the payment, we confirm it by email and you are registered. You will then receive a payment receipt and further information about the training.

19. What does the price include

The price of a training includes the training itself and the material handed out during it. If it is necessary to purchase material separately — a book — it will be mentioned on the webpage of the training and in an email with information about the course.

20. Cancelling or rescheduling

Cancelling or rescheduling can only be done by filling in the contact form or sending an email.

If you cancel up to four weeks in advance, the registration fee will be refunded, minus a €25 administrative fee. We refund within fourteen days of the cancellation.

If you cancel within four weeks of the start of the training, the whole fee is due.

If a participant cannot attend the training, someone else may take their place free of charge, as long as the replacement meets the entry requirements for that training. The original buyer remains liable for the fee. Information about the replacement needs to be confirmed by the original participant before the start of the training.

You may reschedule your course to another date, but this implies an administration fee of €25. Rescheduling is no longer possible within the four weeks before the start of the training.

21. In case BREA cancels or postpones

A training needs a group large enough to be worth running. If too few people register, the training may be postponed or cancelled. We tell you as soon as we know. If the training is cancelled, we refund the paid fee within fourteen days. When a training is postponed you have the option to ask for a refund instead of starting the training at the new date.

Beyond the refund, no further compensation is due for a cancellation or postponement of this kind.

22. If a teacher cannot be there

In the case that a teacher falls ill, or something else outside our control prevents the training from continuing, we shall do everything we can to find a solution. If we cannot, we tell you as soon as possible and set a new date. If you decide to cancel because of it, we will refund the fee within fourteen days. No further compensation is due.

23. If a participant drops out after the start

If illness or another circumstance outside your control stops you from participating in a training that has already begun, BREA lets you attend the missed days at a later date for a fee of €100 per day of training.

24. Certificates and accreditation

Every participant receives a certificate of participation stating the hours of the training.

Some trainings are accredited by the International Society for Cognitive Rehabilitation (iSCR) and lead to the international Certification in the Practice of Cognitive Rehabilitation Therapy (CPCRT).

25. Patient confidentiality

In a training, case studies are reviewed. It is important that the participants take responsibility for patient confidentiality and do not share personal patient information. Participants are prohibited from discussing cases reviewed during the training with non-participants, and may not record the day in sound or picture.

In-company training

26. Quotation and order

At your request BREA will submit a proposal for an in-company training with a quotation. The proposal is valid for three months from the date of issue. You accept the proposal and quotation and these terms and conditions by returning the quotation to BREA with a signature for approval.

27. Payment

Once the location, the time and the number of participants are agreed, BREA will invoice 50% of the quoted amount. As soon as 50% of the quoted amount is received, the training will be confirmed by BREA.

The remainder of the quotation is invoiced four weeks before the training. This amount must be paid to BREA two weeks prior to the training. Should timely payment not be received, the training will not take place.

28. Prices

The quoted price covers the in-company training only. For each training, the quotation specifies which materials you must provide yourself. The costs for the location, audio-visual equipment, and refreshments (coffee, tea, lunch) for the instructors during the training are at your expense.

Changes in law and statutory regulations may require BREA to adjust prices accordingly. Any resulting price differences will be charged to you.

29. Cancelling

Cancellation of the in-company training must be done in writing by email.

Cancellation is possible for 14 days from the date of the invoice for the first 50% of the quoted amount. If you cancel the training within these 14 days, you are entitled to a refund of this payment.

Cancellation is possible up to a period of no later than two weeks before the start of the training. For a “customized in-company training”, 50% of the quoted amount will be charged to you upon cancellation. For an “in-company training based on an open enrolment course or workshop”, 10% of the quoted amount will be charged to you upon cancellation. In the event of cancellation within the period of two weeks before the start of the in-company training, the total quoted price will be maintained.

Money already received that is no longer due is refunded within four weeks of the cancellation.

If an instructor falls ill or something outside our control intervenes, BREA will do everything it can to provide a replacement. If no replacement is possible, a new date for the in-company training will be determined in consultation with you.

If you decide to cancel as a result of this circumstance, BREA will refund 100% or 50% of any quoted amount already paid, for the “in-company training based on an open enrolment course or workshop” and the “customized in-company training” respectively, within four weeks to a bank account specified by you. No further compensation is due.

30. Participants

You are responsible for registering the participants and for settling their fees. You are obligated to make these terms and conditions applicable to the participants and to impose this upon them. You indemnify BREA against claims from participants.

31. Certificates

Every participant receives a certificate of participation stating the hours of the training.

Some trainings are accredited by the International Society for Cognitive Rehabilitation (iSCR) and lead to the international Certification in the Practice of Cognitive Rehabilitation Therapy (CPCRT).

BREA does not apply for profession-specific accreditation for in-company trainings.

Books, tests and assessments

32. Ordering

Add what you want to the basket, go to checkout, give your billing details and — for anything physical — the address of delivery, then choose how to pay. You will see the whole order and its total before you pay, and receive a confirmation by email. For physical products, you will receive the invoice together with the order; for downloads, it is sent by email as described in clause 7.

33. Delivery and delivery times

BREA aims to ship items in stock within 7 working days. During holiday periods, BREA may be closed, and delivery will take longer. The dates on which BREA is closed will be announced on the website.

BREA does not bill delivery costs. Unfortunately it is currently not possible to deliver products to the United States of America.

34. Downloads

A download is licensed to you personally, for your own professional practice. You may not copy it for others, publish it, or pass it on. The licence lasts as long as the material is in use and ends if it is passed on.

A download is made available once payment is confirmed. If you are a consumer and want to download the product immediately, you are asked to confirm that you understand that the right of withdrawal ends when the download starts; without that confirmation, the download is not available before the fourteen days are up.

35. Returns and refunds

Before an order is dispatched you may simply ask us to cancel it, and we will if it has not already gone.

You may return your product up to 14 days after delivery. The conditions for returning the products are:

  • You have handled the product and packaging with care.
  • You have only unpacked or used the product to the extent necessary to assess whether you wish to keep the product.

You must return the product with all supplied accessories and — if reasonably possible — in its original condition and packaging. The costs for returning your order are at your own expense. We refund the price within fourteen days of receiving the return. When an order has several items and you return one, only that item’s price is refunded.

36. Damaged or wrong deliveries

If you receive an incorrect or damaged product, you can contact BREA. BREA will only resolve problems reported within five working days of receipt of the product.
